1. Acceptance of Terms

These Terms of Service ("Agreement") govern your access to and use of the Orion Learning platform, including the Nebula Library, Stellar Quizzing engines, and clinical simulations (the "Services"). By creating an account or accessing the Services, you enter into a binding legal contract with Orion Learning LLC.

If you do not agree to these terms, you may not access or use the software. Use of the software is strictly limited to authorized clinical students and educators.

2. Clinical & Medical Disclaimer

ORION IS NOT A MEDICAL DEVICE.

The software provides simulated clinical scenarios and educational assessments based on standard EMS curricula (e.g., NREMT, AHA, IBSC). However, medical knowledge is constantly evolving. Orion Learning does not warrant that the content is error-free or reflective of the latest clinical updates at any specific moment.

Reliance on any information provided by Orion is solely at your own risk. You must always adhere to the specific protocols, Standing Orders, and Medical Director guidance of your certifying agency.

3. Permitted License & Restrictions

Orion Learning grants you a personal, non-exclusive, non-transferable, limited license to use the Services for individual clinical study. You shall not:

  • 3.1 Share login credentials with third parties or allow concurrent sessions.
  • 3.2 Use any automated system, including "robots" or "scrapers," to access Nebula content.
  • 3.3 Circumvent the adaptive logic of the "Stellar" engine to artificially inflate scores.

5. DISCLAIMER OF WARRANTIES & LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. ORION LEARNING HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE SERVICES, EITHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, OF SATISFACTORY QUALITY, AND OF FITNESS FOR A PARTICULAR PURPOSE.

IN NO EVENT SHALL ORION LEARNING, ITS AFFILIATES, OR AGENTS BE LIABLE FOR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE SERVICES, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, OR OTHERWISE).
